I've been following you with interest from Australia, so have a few folk in a common law assembly here. I become a paid subscriber, I can't receive this level of insight without gratitude.
You mention that "anyone can issue a summons under an invented court name and pretend it’s lawful". You should issue these infidels a fine from a court of the name of your choosing, structured and obfuscated in the same style!
I don't expect a reply .. you're busy enough. Keep safe.
Your sustained efforts are a judicial version of the story of The Emperor's New Clothes...and more people are noticing as what was once "invisible" is gradually becoming "visible". Press on !
I’m still at it…dear Sian wanted me to drop WDTK foi and submit an email to her office
Dear Siân E. Jones, Head of Legal and Professional Services, National Legal Operations, Her Majesty’s Courts and Tribunals Service (HMCTS),
Re: Freedom of Information (FOI) Request 250709054 – Internal Review (1 August 2025)
I request an internal review of your Freedom of Information (FOI) response (Reference 250709054, 1 August 2025), which deems my request invalid under the Freedom of Information Act 2000 (FOIA). Your interpretation—that my questions seek explanations rather than recorded information—is overly restrictive, as they request existing records (e.g., Her Majesty’s Courts and Tribunals Service (HMCTS) guidance, emails). Your admission that no recorded information exists on Local Justice Area (LJA) naming authority for courts, such as East Hampshire Magistrates’ Court, contradicts the Portsmouth Magistrates’ Court (PMC) emails (3 March 2023, 15 July 2025), suggesting maladministration in revenue-driven council tax enforcement via the Single Justice Procedure (SJP).
Key concerns include:
1. **Contradictions in Local Justice Area (LJA) Naming**:
- The Portsmouth Magistrates’ Court (PMC) email (3 March 2023) to Fareham Borough Council (FBC) instructed using East Hampshire Magistrates’ Court, claiming it is “acceptable,” while the Portsmouth Magistrates’ Court (PMC) email (15 July 2025) cites the Local Justice Areas Order 2016 (S.I. 2016/941). Your Freedom of Information (FOI) response confirms no recorded authority, contradicting these claims. The Courts Act 2003, section 10, defines Local Justice Areas (LJAs) as administrative, not courts.
2. **Systemic ‘Ghost Court’ Issues**:
- Martin Geddes’s Substack articles (https://open.substack.com/pub/martingeddes) highlight similar “ghost courts” (e.g., North and West Cumbria Magistrates’ Court), with a Freedom of Information (FOI) response (14 May 2025) confirming no statutory authority. This suggests jurisdictional fraud in Single Justice Procedure (SJP) cases, affecting 3.1 million cases (2019-2023), violating the European Convention on Human Rights (ECHR) Article 6 and *Anisminic Ltd v Foreign Compensation Commission* [1969] 2 AC 147.
3. **Courtserve Omissions**:
- Council tax hearings are not listed on Courtserve.net, unlike other cases, breaching open justice (*R (on the application of D) v Manchester City Council* [2020]), supporting revenue-driven opacity (e.g., £100m+ for Southampton City Council, 2023-2024).
Please provide recorded information on:
1. Her Majesty’s Courts and Tribunals Service (HMCTS) or Ministry of Justice (MOJ) records (2020-2025) on Local Justice Area (LJA) naming in council tax summonses (e.g., East Hampshire Magistrates’ Court).
2. Guidance to Portsmouth Magistrates’ Court (PMC) staff (e.g., Mrs. F. Thornton-Dale) on summons naming.
3. Timeline and drafts of your promised Local Justice Area (LJA) naming guidance (Freedom of Information (FOI) 250709054).
4. Records confirming non-listing of council tax hearings on Courtserve.net.
I absolutely LOVE this. I'm sending it in its entirety to various council employees who have taken it upon themselves to issue Order for Sale on people's properties because they missed several council tax payments, based on Liability Orders from similar 'courts' - North & Mid Kent Magistrates is a favourite ghost court, and 'Legal Advisor Hutchinson' as the ghost (non-existent) signatory of the CNBC Northampton poor photocopy giving authority, in my neck of the woods. Beautifully written (am using AI legal full tilt myself and piggy backing on the judicial reviews) and humorous too. Bravo! A perfect, dysfunctional analogy - love it, love it. I salute you Martin Geddes.
I've really had to read between the lines here. I get the jyst though .I see the bottom line here is . If its a fake court anywhere..it hasn't been judged ..so any outcome ..is void !
Even if summons to a court now, I would not attend ..the paperwork is fake, fraudulent Void ..because there are rules t
hat have been bypassed..Strict RULES. No legal or lawful standing
