Tips on using AI to aid legal drafting
Lessons from my own litigation campaign that may help you do your own
Recently, I received an enforcement notice from Marston regarding a purported motoring fine. This arrived despite my repeated and reasonable requests for HMCTS to provide evidence of lawful authority to issue and collect the fine, including a sealed court order. I have been clear that I am willing to pay upon receipt of such evidence. At the same time, the matter now sits within the scope of two Judicial Review paths: a broader constitutional challenge concerning non-statutory court names, and a personal application seeking to stay enforcement pending determination of the underlying jurisdiction issues. Attempts to obtain progress through ordinary complaints channels and pre-action procedures have produced no meaningful resolution.
In the past, this situation would have left me without practical recourse. Accessing the High Court’s supervisory jurisdiction requires specialised procedural knowledge that was previously beyond my capacity, though not my capability. I am deeply grateful for the loyalty and support of my readers during a period when I am still recovering from years of strain — media smears, personal betrayals, Covid-era upheaval, family disruptions, deplatforming, and overseas legal turmoil not of my making. Even this week, a needlessly aggressive email triggered an adrenaline spike that took me a three-hour walk to shed before I could resume work.
The advent of AI now provides an essential buffer between individuals and the machinery of bureaucracy. I can ask a computer to perform an initial pass on correspondence when I feel overwhelmed. It handles the clerical and organisational demands that would otherwise consume the energy I need for structuring my arguments. It can even simulate a “friendly judge” by stress-testing my reasoning; nothing I publish goes out without multiple rounds of refinement. The art is in understanding what AI can shoulder — and what remains irreducibly human, personal, and accountable.
Here are some pointers that may help you to adopt this technology safely and effectively.
The output of AI is only as good as what you put in. If your filing is chaotic, the AI’s advice will be chaotic. Keep your document archive structured. Print important emails to PDF so everything sits in one location. AI cannot compensate for a disorganised source corpus.
Maintain a master timeline covering every single interaction relevant to your case, with brief summary paragraphs for each episode. It doesn’t need to be polished — accuracy matters more than aesthetics.
Do not presume the AI truly knows current procedural rules or that its first answer is correct. It may rely on outdated practice directions or apply rules meant for a different claim type. Ask it for help, but manually verify everything. Be specific: “Does this comply with these rule subsections?” Vagueness produces vagueness.
You get far better results when you use a second AI as a “red team” to stress-test the first one’s outputs. I blend saving drafts in documents with simple copy-paste review loops between tools. Never allow one AI to dominate the framing. Use the second model explicitly to pull your argument apart and generate competing theories and counterarguments; these systems are trained to be agreeable, so this deliberate adversarial setup matters.
An underused technique is prompting one AI to write the prompt for another. For example, I might ask ChatGPT: “Write a prompt for Grok to conduct a legal authority search on X.” This frequently produces richer insights than attempting to ask the second AI directly.
AI has a kind of “tunnel vision” in any given chat. It won’t notice peripheral context gaps when you jump topics. Don’t do that. If you want consistency across a long document, keep the conversation scope narrow.
For complex filings, start by asking AI to draft a specification of the document — what it must contain, its structure, its purpose. Get the outline right before diving into detail. You will produce a far stronger result, with far less fatigue.
AI can pull a blizzard of case citations. Many will be relevant; some will be wildly misapplied. Always ask for summaries of the cases it cites, and manually check whether the analogy is sound. Never trust a citation without reading its core holding yourself.
When you get a particularly helpful insight from the AI, save it. I maintain an “AI Analysis” subfolder for each case or filing to preserve useful reasoning for later use.
If you receive a legal communication — a defence statement, a response to a PAP letter — ask AI to analyse the subtext. What wasn’t said? What are they avoiding? Often the omissions are more revealing than the assertions.
When reviewing your own legal work, give the AI one job at a time:
“Does this flow logically?”
“Is this the right tone for a judge?”
“Are there any micro-typographical errors?”
Focused tasks yield focused improvements.
It also helps to specify the intended audience: judge, opponent, caseworker, or general public. Tone, structure, and the level of caution should change with the reader, and AI will follow your lead if you state it plainly.
Every AI model has different guardrails and biases. Grok, for instance, is very statutory-orthodox at first, but will shift position when presented with a logically coherent natural-law or constitutional argument. Those shifts are gold — ask it to explain why it changed. That explanation is often your skeleton argument.
Lawfare is not ordinary administrative work. AI is your procedural exoskeleton, not your co-author. I almost never ask it to generate a legal document “from scratch.” That’s your job — and your responsibility.
AI is no substitute for moral clarity. Its training pushes it toward compromise, consensus, and “reasonable-sounding” equilibrium points. It will happily rationalise away your inalienable rights if you let it. You must be the one who holds the sacred line.
AI is excellent at anticipating how a communication lands with its target audience. Ask it: “How will a judge/caseworker/opponent receive this?” It will surface blind spots you didn’t know you had.
AI is brilliant at spotting inconsistencies and contradictions across documents or over time. That drift is often the weakness in the opponent’s narrative. You don’t always need to prove they are wrong — only that they are incoherent. In judicial review, incoherence is often enough to open the door to a real hearing.
Tone is everything. Let the AI strip your text to monochrome. Keep colour for the public. In court filings, judges react to clarity, order, and reason — not passion. AI helps you maintain a dispassionate discipline that victims of wrongdoing normally find impossible.
AI’s training data largely models how the law ought to work, not how it actually functions. It assumes competent clerks, honest attorneys, attentive judges — and a world without missing files, ghost courts, or procedural collapse. But the real world contains all of these. Treat the AI’s idealised map with suspicion, because it is not the terrain you are fighting on.
Never ask AI to do multiple cognitive jobs in one prompt. Structure, logic, compliance, tone, and final QA are distinct stages. Only give the AI the minimum context required for the task at hand.
Write witness statements, affidavits, and factual accounts in your own hand. Then use AI only to tighten the language for court and check procedural correctness. This article is written by me, with AI used purely to ensure legal compliance (as matters are sub judice) and clarity.
The goal isn’t to replace professional lawyers — it is to outperform the system’s limitations. AI allows litigants in person to address structural failures that legal insiders are often unable or not incentivised to tackle. These tools enable a level of precision and ambition that was previously unthinkable.
When the emotional load of adversarial litigation spikes, tell the AI how you feel. It can be a counsellor, stabiliser, and firewall. The reassurance that you are not mad or broken is real value. If it starts recommending the Samaritans, that’s usually the cue for chocolate and coffee.
Be ruthless about scope — macro questions versus micro ones. Never mix the two. AI doesn’t “think” like humans. It won’t ask the obvious adjacent question or challenge the hidden assumption behind your prompt. Discipline and clarity are essential: nonsense in, nonsense out.
Finally: check everything. If it goes out in your name, and you cannot defend every word, delete and rewrite. Never generate–copy–paste–send, and then pray. AI is amplifier technology, not a substitute for human insight. If another human is going to read it, you must personally review it.
